Terms of Service

Nightpress is an AI-assisted novel generation service. You describe a story; Nightpress plans, writes, reviews, and packages a complete manuscript using AI models. By creating an account or using the service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

Nightpress is currently in a closed beta: access is by invitation, features may change, and the service may be interrupted or withdrawn while we build it. Beta status does not change your obligations under these Terms.

To use Nightpress you must:

• be at least 18 years of age;
• reside in the United States; and
• not be a person, or located in a country, subject to comprehensive U.S. sanctions.

The service is offered to residents of the United States only and is not directed at, or intended for use by, persons in the European Union, the European Economic Area, or the United Kingdom. We may use technical measures (such as region blocking) to enforce this, and we may suspend accounts that circumvent them or that were created on the basis of an inaccurate eligibility confirmation.

During the beta, every account includes a writing allowance funded by Nightpress — you can plan, write, and review books without providing an API key. The allowance is promotional, has no cash value, cannot be transferred or redeemed, and may be adjusted or discontinued; material changes will be announced in the app.

Optionally, you may connect your own Anthropic API key. AI model usage on your key (planning, writing, review, metadata) is billed directly by Anthropic to you — Nightpress does not resell or mark up that usage. Cover image generation is billed to the platform.

When running on your own key, you are responsible for the API charges your runs incur. Nightpress provides cost estimates and per-book spend limits, but estimates are approximate and actual charges are determined by your API provider.

You own your story inputs (premises, outlines, edits) and the manuscripts generated from them, to the maximum extent permitted by applicable law. Nightpress claims no ownership of your books. We use your content only to operate the service (e.g., sending it to the AI model on your behalf) — never to train models and never shared with other users, except through share links you create, which you can revoke at any time.

You are responsible for the inputs you provide. You represent that you have the rights needed to use them and that they do not infringe anyone else's intellectual property or other rights.

The full Acceptable Use Policy is part of these Terms and controls what Nightpress will and won't write, how requests are screened, and how violations are handled (guidance, strikes, suspension, termination). In short, you agree not to use Nightpress to create or distribute:

• Content that is illegal in your jurisdiction or ours.
• Content that violates Anthropic's Usage Policy, which governs the underlying AI models.
• Child sexual abuse material (CSAM) or any sexualized depiction of minors, in any form, real or fictional. This results in immediate account termination and reporting to law enforcement or the National Center for Missing & Exploited Children where required or permitted by law.
• Content intended to harass, defame, or incite violence against real people or groups.
• Content that infringes another person's copyright, trademark, or other rights.

You also agree not to probe, scrape, reverse-engineer, or interfere with the service, or to share your account or invitation with others. Repeatedly rewording a request that was declined, to get it past screening, is itself a violation whether or not any attempt succeeds.

Accounts that violate this section may be disabled or terminated without notice. We may retain records of violations as needed to investigate, enforce these Terms, and comply with law.

Manuscripts produced by Nightpress are machine-generated by artificial intelligence. You are responsible for reviewing, editing, and fact-checking your manuscript before publishing or otherwise distributing it.

Copyright notice. Under current United States law, material generated entirely by AI is generally not eligible for copyright protection; human authorship is required. Only your own human-authored contributions — such as substantial edits, additions, or the creative selection and arrangement of the work — may be protectable, and the extent of that protection is a fact-specific legal question we cannot answer for you. Nightpress makes no representation that any manuscript, in whole or in part, is or will be protected by copyright, and we do not provide legal advice.

Many retail platforms have disclosure obligations for AI-generated work — for example, Amazon KDP requires you to disclose whether content is AI-generated during title setup. Complying with those obligations is your responsibility.

AI output can be inaccurate and may unintentionally resemble existing works. Nightpress makes no guarantee regarding the originality, quality, marketability, or legal status of generated content.

We respect intellectual property rights. If you believe content on Nightpress infringes your copyright, send a notice that satisfies the requirements of 17 U.S.C. § 512(c)(3) — identification of the copyrighted work, identification of the allegedly infringing material and its location, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature — to dmca@nightpress.ai. We may remove or disable access to the material, notify the account holder, and terminate the accounts of repeat infringers.

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated manuscripts will meet your expectations.

To the fullest extent permitted by law, Nightpress and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the service or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages.

Our total liability for all claims arising out of or related to the service or these Terms will not exceed the greater of (a) the amounts you paid Nightpress for the service in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent the law permits.

You agree to defend, indemnify, and hold harmless Nightpress and its owners and operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your inputs, your use of manuscripts generated for you, or your violation of these Terms or of any law or third-party right.

You may stop using Nightpress at any time. We may suspend or terminate accounts that violate these Terms, abuse the service, or create risk for other users or the platform. Where practical, we will notify you and give you an opportunity to export your books first.

You can permanently delete your account and all of your books at any time from Settings. Deletion is immediate and irreversible — see the Privacy Policy for details on what is stored and how deletion works.

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing a claim, you agree to contact us at legal@nightpress.ai and make a good-faith attempt to resolve the dispute informally for at least thirty (30) days.

We may update these Terms from time to time. Material changes will be announced in the app, and continued use after a change constitutes acceptance of the updated Terms. If any provision of these Terms is found unenforceable, the remainder stays in effect.
